Ware received his Bachelor of Arts degree
with High Distinction from the University
of Nevada at Las Vegas in 1986. He graduated
from Loyola Law School (Cum Laude) in 1989
and is a member of Order of the Coif. Mr.
Ware was admitted to practice law in California
in 1989 and in Nevada in 1991. He is admitted
to practice before the Ninth Circuit Court
of Appeals and the United States District
Court for the Central, Eastern and Southern
Districts of California. Mr. Ware remains
an active member of the Nevada Bar.
Since 1989, Mr. Ware’s practice has
focused on the representation of homeowner
associations, including condominiums, stock
cooperatives, planned unit developments,
and other community associations, and their
volunteer directors and officers.
Mr. Ware’s representation in the field
of common interest developments has been varied.
In litigation matters, he has represented
associations and/or their directors and officers
in numerous construction defect cases, developer
disputes, CC&R enforcement matters, land
use disputes, controversies involving architectural
modifications and other use restrictions,
disputes involving alleged breaches of fiduciary
duty, assessment collection, lender and contractor
disputes, corporate matters, and insurance
related matters. He also has represented associations
in connection with general corporate issues,
questions concerning CC&R and By-law provisions,
preparation of amendments to governing documents,
insurance matters, and general issues relating
to associations’ and directors’
fiduciary obligations.
Mr. Ware was one of the attorneys of record
for the prevailing parties in the landmark
California Supreme Court case Nahrstedt v.
Lakeside Village Condominium Association,
8 Cal.4th 361 (1994). This case established
the legal framework and standards for enforcing
CC&R provisions. Mr. Ware was also appellate
counsel in Martin v. Bridgeport Community
Assn., 173 Cal.App.4th 1024, which holds
that CC&Rs can be enforced against tenants
but tenants lack standing to enforce the
CC&Rs against the Homeowners Association.
Mr.
Ware was selected for inclusion in Super
Lawyers 2009®,
published in Los Angeles Magazine. Mr. Ware
has an “AV”
rating by Martindale-Hubbell.®

Joseph
Serpico received his Bachelor of Arts degree
in political science (Cum Laude) from California
State University, Northridge in 1973. He received
his Juris Doctor degree from Southwestern
University School of Law in 1976. He has practiced
law in Los Angeles since 1977. Mr. Serpico
is admitted to practice in the United States
District Court for the Central District of
California and is a member of the American
Bar Association, the Los Angeles County Bar
Association, and the Community Associations
Institute.
Mr. Serpico specializes in civil litigation,
including real property, products liability,
construction defects, and the representation
of community associations, both as general
counsel and as litigation counsel. He was
counsel for the prevailing defendant in Blackwell
v. Phelps Dodge Corp. 157 Cal.App.3d, 372
(1984), a published decision in the area of
products liability failure to warn. Mr. Serpico
has obtained many substantial recoveries for
condominium homeowner associations in multi-party
construction defect litigation.

Brachman received his Bachelor of Arts degree

of Michigan in 1983. He received his Juris
Doctor from Washington College of Law, The
American University in 1986. Mr. Brachman
was admitted to practice law in the State
of California in 1987 and in the District
of Columbia in 1990. He is also admitted
to practice in the United States District
Court for the Central and Northern Districts
of California.
Mr. Brachman specializes in civil litigation,
including real property, construction defects,
mortgage broker errors and omissions. His
real estate practice is particularly focused

and their volunteer directors and officers.

Ms. Lin is a member of the Southern California

Bernardoni practices in the area of business
litigation. Mr. Bernardoni represents clients
in state and federal court. He has represented
a diverse range of clients, including large
and small businesses in the communications,
construction, insurance and retail industries.
Mr. Bernardoni’s current case load
includes the defense of homeoners associations
and their volunteer board of directors.
Examples of recent successes in the defense
of homeowners associations include:
• Obtained the dismissal a homeowners
association and its individual homeowners
(by way of demurrer) in an action brought
against for personal injuries;
• Prevailed on multiple anti-SLAPP
motions against homeowner associations and
their board of directors with award of attorneys
fees and costs as prevailing parties;
• Prevailed on a pre-trial motion
for judgment on the pleadings against a
cross-complaint relating to a homeowner
association’s enforcement of its architectural
standards;
• Prevailed on motion for terminating
sanctions against a plaintiff for violations
of the Discovery Act after obtaining a dismissal
from the other plaintiff in exchange for
waiver of costs and fees;
• Obtained the voluntary dismissal
of a homeowner association president after
filing a motion for summary judgment. Obtained
a money judgment in favor of said defendant
in excess of $70,000;
• Obtained dismissal of a multiple
defendant board members in multiple actions
in exchange for waiver of costs and fees.
Mr. Bernardoni is a 2003 graduate of the
University of San Diego School of Law, where
he served as a Lead Articles Editor for
the San Diego Law Review. Prior to attending
law school, Mr. Bernardoni was a training
manager for Sprint PCS, where he trained
over 1,000 employees in conjunction with
the launch of the Sprint PCS network in
cities throughout the county.
Prior to joining Kulik, Gottesman, Mouton
& Siegel in 2006, Mr. Bernardoni was
associated with the law firm Ropers, Majeski
Kohn & Bentley, where he defended over
80 first-party contract and bad faith cases
arising out of the adjustment of claims
from the 1994 Northridge earthquake.
In 2008, Mr. Bernardoni was elected to the
Lake Balboa Neighborhood Council, for which
he currently serves as its President.

Hastings, Janofsky & Walker in Washington,

Noah Perch-Ahern received his law degree,
magna cum laude, from Tulane University
Law School in 2006, where he received Tulane's
Environmental Law Certificate and was a
managing editor of the Tulane Environmental
Law Journal. While in law school
Mr. Perch-Ahern's comment, "Broad
Programmatic Attacks: SUWA, the Lower Courts'
Responses, and the Law of Agency Inaction," was
published in the Tulane Environmental Law
Journal and won first prize in the Louisiana
State Bar Association's annual environmental
law essay contest. Mr. Perch-Ahern
received his B.A. in political science,
summa cum laude, from the University of
New Hampshire in 2003 where he participated
