Thomas
Ware received his Bachelor of Arts degree
with High Distinction from the University
of Nevada at Las Vegas in 1986. He graduated
from Loyola Law School (Cum Laude) in 1989
and is a member of Order of the Coif. Mr.
Ware was admitted to practice law in California
in 1989 and in Nevada in 1991. He is admitted
to practice before the Ninth Circuit Court
of Appeals and the United States District
Court for the Central District of California.
Mr. Ware remains an active member of the Nevada
Bar.
Since 1989, Mr. Ware’s practice has
focused on the representation of homeowner
associations, including condominiums, stock
cooperatives, planned unit developments, and
other community associations, and their volunteer
directors and officers.
Mr. Ware’s representation in the field
of common interest developments has been varied.
In litigation matters, he has represented
associations and/or their directors and officers
in numerous construction defect cases, developer
disputes, CC&R enforcement matters, land
use disputes, controversies involving architectural
modifications and other use restrictions,
disputes involving alleged breaches of fiduciary
duty, assessment collection, lender and contractor
disputes, corporate matters, and insurance
related matters. He also has represented associations
in connection with general corporate issues,
questions concerning CC&R and By-law provisions,
preparation of amendments to governing documents,
insurance matters, and general issues relating
to associations’ and directors’
fiduciary obligations.
Mr. Ware was one of the attorneys of record
for the prevailing parties in the landmark
California Supreme Court case Nahrstedt v.
Lakeside Village Condominium Association,
8 Cal.4th 361 (1994). This case established
the legal framework and standards for enforcing
CC&R provisions. Mr. Ware has an “AV”
rating by Martindale-Hubbell.®
Prior to joining Kulik, Gottesman, Mouton
& Siegel, Mr. Ware was a partner in the
law firm of Wilner, Klein & Siegel.

Joseph Serpico's Bio

Joseph
Serpico received his Bachelor of Arts degree
in political science (Cum Laude) from California
State University, Northridge in 1973. He received
his Juris Doctor degree from Southwestern
University School of Law in 1976. He has practiced
law in Los Angeles since 1977. Mr. Serpico
is admitted to practice in the United States
District Court for the Central District of
California and is a member of the American
Bar Association, the Los Angeles County Bar
Association, and the Community Associations
Institute.
Mr. Serpico specializes in civil litigation,
including real property, products liability,
construction defects, and the representation
of community associations, both as general
counsel and as litigation counsel. He was
counsel for the prevailing defendant in Blackwell
v. Phelps Dodge Corp. 157 Cal.App.3d, 372
(1984), a published decision in the area of
products liability failure to warn. Mr. Serpico
has obtained many substantial recoveries for
condominium homeowner associations in multi-party
construction defect litigation.

Mr.
Mitrovich received his Bachelor of Arts degree
in 1981 from Occidental College, where he
majored in History and Political Science (Cum
Laude). He was named to the American Historical
Honor Society, and he was on the editorial
staff of the Occidental College Newspaper.
He obtained a Master’s Degree in Journalism
from the Medill School of Journalism at Northwestern
University in 1982, graduating with honors.
Mr. Mitrovich received his law degree from
the University of Southern California in 1986,
graduating with honors, and was a semi-finalist
in the National Moot Court Honors Competition.
He earned a Master’s Degree in Business
Administration from Pepperdine University,
graduating with honors in 1991.
Mr. Mitrovich is an experienced trial attorney
whose practice includes complex insurance
coverage matters, business litigation, construction
defect, officer and director liability, professional
malpractice, entertainment, and the representation
of community associations in litigation. He
has represented some of the largest developers
in the country in significant construction
defect and insurance coverage cases. He is
admitted to practice in all of the courts
of the State of California, the United States
District Court for the Southern, Northern
and Central Districts of California, and the
Ninth Circuit Court of Appeals.
Mr. Mitrovich also has experience as a journalist,
writing on defense and foreign policy matters
for various publications. Prior to joining
Kulik, Gottesman, Mouton & Siegel, LLP
Mr. Mitrovich was a partner in the law firm
of Berger Kahn, and prior thereto was a partner
in the law firm of Williams, Smyth & Jacks.

Brachman received his Bachelor of Arts degree

of Michigan in 1983. He received his Juris
Doctor from Washington College of Law, The
American University in 1986. Mr. Brachman
was admitted to practice law in the State

of Columbia in 1990. He is also admitted
to practice in the United States District
Court for the Central and Northern Districts
of California.
Mr. Brachman specializes in civil litigation,

mortgage broker errors and omissions. His
real estate practice is particularly focused
on the representation of homeowners associations
and their volunteer directors and officers.
This representation includes representation

involving interpretation of Association

Sharon
Barber obtained her Bachelor of Arts degree
from Tufts University (magna cum laude)
in 1996. She proceeded to obtain her Juris
Doctor degree from the University of Southern
California School of Law in 1999. She is admitted
to practice in California and New York, and
remains an active member of both states' bars.
Mrs. Barber has experience in trade secrets
and unfair competition litigation, breach
of contract disputes, and class actions. She
also has experience handling a wide range
of labor and employment matters, including
labor arbitration, collective bargaining,
discrimination, harassment, wrongful discharge,
and wage and hour claims. In addition, Mrs.
Barber has worked with employers by creating
policies, handbooks, and training programs
geared towards preventing litigation in the
workplace. She has experience litigating in
both state and federal court.

Mitchell is a 2001 graduate of Loyola Law

California, Santa Barbara, where she graduated
with honors. At Loyola, Ms. Mitchell was a
member of the Scott Moot Court Honors Board.
Ms. Mitchell is experienced in all aspects
of civil litigation including employment law,
business litigation and products liability.
Ms. Mitchell was appointed to serve on the
national Plaintiff Steering Committee for
the Multi District Litigation pending in the
Eastern District of Arkansas for Hormone Therapy,
including Prempro and Premarin. She is a member
